SplashTaker welcomes you and thanks you for choosing to browse the website at: https://www.splashtaker.co.il ("the Website"). The Website is operated by "Milman Ze Yichudi" (Milman It's Unique), an exempt dealer (osek patur), 27 Zevulun St., Kiryat Ata, Israel.

SplashTaker is a store for the purchase of a unique product — a toilet guard for the prevention of urine splashing. The Website was established in order to provide visitors and the Website's customers with a purchasing experience for the product offered for sale in the store (hereinafter: "the Product"). The Website also provides information about the Product offered for sale in the store and on the Website.

General

Browsing the Website is subject to the terms set out in these Terms of Use ("the Terms"). Please read the Terms carefully, as browsing the Website and performing actions on it constitute your agreement to the terms contained herein. The Website reserves the right to amend the Terms from time to time, at its sole discretion and without prior notice. Any such amendment shall take effect upon its publication on the Website.

The provisions of these Terms apply equally to all genders; the use of masculine language is for convenience only.

The Terms apply to the use of the Website and the content contained in it via any computer or other communication device (such as a mobile phone, tablet, etc.). They likewise apply to use of the Website whether via the internet or via any other network or means of communication.

Purchases on the Website are intended for persons with legal capacity aged 18 and over only. A purchase by a minor under the age of 18 requires the approval of a parent or guardian.

To the extent that the user is a minor (under the age of 18), the user declares and confirms that the purchase they wish to make is of the type customarily made by minors of their age and/or that they have obtained the consent of their natural and/or legal guardians to make it.

Should any provision of these Terms be determined to be unenforceable or invalid for any reason, this shall not affect or impair the legality, validity, and enforceability of the remaining provisions of the Terms.

Browsing the Website

Browsing and viewing the Website do not require registration, and the Website is open to all visitors.

No purchase may be made on the Website on behalf of another person without their consent and/or without their presence in front of the screen at the time of purchase and after all the Terms have been explained to them.

When leaving details or making a purchase on the Website, the visitor will be asked to provide personal details such as: first name, surname, residential address, and an active email address (at the Website's discretion). Providing partial or incorrect details may prevent use of the Website's services and frustrate contact where necessary. In the event of a change in details, they should be updated on the Website.

The Website shall not use the details provided except in accordance with the Website's Privacy Policy, which constitutes an integral part of these Terms.

The Website may prevent any visitor from using the Website at its absolute discretion. Without derogating from the above, the Website may prevent a visitor from browsing, or block their access to the Website, in any of the following cases:

If, at the time of purchase or registration on the Website, incorrect details were deliberately provided;
If the Website was used to commit, or to attempt to commit, an act that is unlawful under the laws of the State of Israel, or an act that appears on its face to be unlawful, or to enable, facilitate, assist, or encourage the commission of such an act;
If the Website was used in an attempt to compete with the Website;
If these Terms were breached;
If the visitor performed any action that would prevent others from joining the Website or from continuing to use the Website in any way.

The Product Offered for Sale on the Website

The name of the Product offered on the Website appears on the Website's pages.

The Website is not obligated, in any way, to maintain any particular range of products or services.

The Website may at any time change the range of products offered for sale on the Website, replace them, reduce them, or add to them, without any prior notice or warning.

The manner in which products or services are presented on the Website is at the Website's sole discretion.

Purchasing a Product on the Website

The Product may be purchased through the Website conveniently, easily, and securely.

Payment for a purchase on the Website shall be made by credit card belonging to the purchaser or by any other payment method appearing on the payment page.

In addition to the provisions of these Terms, the terms of the payment-processing company or other payment provider shall also apply. Notwithstanding the above, the Website reserves the right to establish other payment arrangements for purchasers, all at its sole discretion.

Purchases on the Website are subject to approval of the transaction by the credit card company. In the event that the transaction is not approved by the credit card company, the purchaser will receive notice and their account will not be charged for the transaction.

Product Pricing on the Website

The price appearing on the Website alongside the Product is the Product's current price. The Website may update the price of the Product offered for sale on the Website from time to time, regardless of the timing of any purchase on the Website, and without any need for notice.

From time to time, the Website may offer visitors and registered users various promotions and discounts. The Website may offer such promotions and discounts, and change or discontinue them at any time, all at its discretion.

The price on the Website does not include installation or assembly of the Product. Assembly services will be provided for an additional charge as stated on the Website.

Delivery Policy

Orders placed on the Website will be processed and delivered to the customer in one of the following ways, at the customer's choice:

Door-to-door courier delivery, anywhere in Israel, within up to 10 business days from the date of order confirmation. Shipping cost: NIS 29.
Self-collection, free of charge, from 27 Zevulun St., Kiryat Ata, by prior arrangement by phone at 052-4336163.

"Business day" — Sunday through Thursday, excluding national public holidays, holiday eves, and days on which banks in Israel are closed.

There is no minimum order amount on the Website; the Website may set a minimum order amount at any time.

In the event that a product ordered on the Website is not available in stock, the Website will notify the purchaser.

Delivery of orders is available within the State of Israel, subject to the following conditions:

There is reasonable access to the delivery location;
The Website's courier company delivers to that area;
In the case of an organization, institution, kibbutz, or locality that cannot be reached without special authorization and/or that does not have an orderly registry of streets and/or house numbers, the order will be delivered to the central distribution point at that location.

The Website shall not be liable for any delay and/or holdup in delivery and/or non-delivery caused as a result of:

Force majeure and/or events beyond the Website's control;
Reasons related to the courier company;
A shutdown of the economy affecting the operations of the Website and/or its suppliers and/or its service providers, for any reason.

Returns, Changes, and Order Cancellation Policy

Requests for a refund, change, or cancellation of a transaction shall be submitted to the Website through one of the contact channels listed at the bottom of these Terms, or via the online form on the Website.

A refund, change, or cancellation of an order shall be available — by way of a monetary refund or an exchange — within a period of up to 14 days from the date the order was received by the customer.

Monetary refunds shall be issued via the payment method used by the customer to place the order.

Where a refund, change, or cancellation is requested more than 14 days after receipt of the order, such request shall, as a rule, not be granted, or shall be granted solely at the exclusive discretion of the Website.

A refund, change, or cancellation shall take effect once the customer has received written notice from the Website confirming it.

Where a refund, change, or cancellation is made because the customer has changed their mind (and not due to a defect or non-conformity), it shall be approved by the Website subject to the following conditions:

The product is returned together with the transaction invoice or proof of purchase;
The product is inspected and returned whole, clean, and undamaged, packed in its original packaging with all of its parts;
The customer encloses a letter/explanation (if required) including the order details;
The costs involved in returning the order shall be borne by the customer;
A cancellation fee of 5% of the product price or NIS 100 (whichever is lower) shall be charged.

Installing the product for the purpose of checking its fit to the toilet, and removing it shortly thereafter, shall not be deemed use of the product and shall not negate the right of cancellation, provided the product is returned whole, clean, undamaged, and with all of its parts and accessories in its original packaging. However, a product that has been actually used beyond such a fit check may not be returned, in accordance with the provisions of the law. Opening the packaging shall not, in and of itself, negate the right of cancellation.

A product reported as defective by the customer shall be inspected by the Website. If, following the Website's inspection, the product is found to be in working order and/or the product was damaged after being received by the customer, the customer shall not receive a refund and may request that the product be shipped back to them, subject to payment of an additional shipping fee, all in accordance with the Website's delivery policy.

Where the product was returned due to a product defect or an error on the part of the Website, and the Website's team has confirmed this, the shipping cost shall be reimbursed by the Website.

Supplier's delivery commitment and cancellation by the supplier: We undertake to deliver the ordered product within 10 business days from the date of order confirmation, by door-to-door courier delivery at a cost of NIS 29. In exceptional cases where the order cannot be delivered on time (including due to stock shortage or a delay in supply from abroad), the Website shall notify the customer promptly, and the customer shall be entitled to choose between waiting for a new delivery date to be coordinated with them and cancelling the order and receiving a full refund of the amount paid, without any cancellation fee. The refund shall be issued via the original payment method within 14 days of the date of cancellation.

The provisions of this section are subject to the Consumer Protection Law, 5741-1981.

The Website's Liability

The Website and/or anyone acting on its behalf shall not be liable, directly or indirectly, for any damage — including but not limited to: direct, indirect, consequential, incidental, special, or ancillary damage — caused to the customer or to any third party as a result of use of the Product, inability to use it, or reliance on any information related to it. Use of the Product is at the user's sole responsibility. Nothing stated on the Website, in the user guide, or in any other marketing material constitutes professional, medical, or safety advice. Sole responsibility for verifying the Product's suitability for the user's needs, and for the manner in which it is used, rests with the customer alone.

The Website and the business operating it undertake to supply the customer with a functioning, new, non-defective product — in accordance with the product description appearing on the Website at the time the order was placed. The Product will be shipped in proper condition, packed in accordance with accepted standards, and free of defects arising from manufacturing or storage.

As a rule, the Product comes with a warranty of one year from the date of purchase, covering all parts of the Product, and against manufacturing defects only. The warranty does not cover reasonable wear and tear from use, damage caused by incorrect installation, improper use, poor maintenance, use of harsh chemical cleaners, or intentional/unintentional damage to the Product.

To exercise the warranty, the customer must contact the Website's customer service and present proof of purchase (order number/receipt) as well as a description of the problem and/or documentation (photo or video if required). We will review the request, and if it is found to be a defect covered by the warranty terms, a replacement product unit will be sent to the customer or the option of a refund will be offered, at our discretion.

The Website reserves the right to update the warranty terms from time to time, as needed, provided that such changes shall not apply retroactively to purchases made before the date of the update.

Liability for a defective or faulty product is limited to replacement of the product or the value of the product. The Website's total liability with respect to any product shall in no event exceed the purchase price of that product. Furthermore, product liability does not include any additional compensation of any kind — monetary, indirect, or consequential — including but not limited to: emotional distress, property damage, bodily injury, or third-party expenses.

The information appearing on the Website, including product descriptions, recommendations, reviews, or any other content, is intended to provide general information only and does not constitute professional, medical, engineering, or other advice. Any reliance on the Website's content is at the user's sole responsibility. The customer is responsible for independently verifying, or consulting a qualified professional regarding, the Product's suitability for their personal needs, including health, orthopedic, sanitary, or safety needs.

The Website is not liable for any direct, indirect, incidental, or consequential damage caused as a result of use of the toilet guard, including cases of slipping, incompatibility with a particular toilet, or a reaction to the material from which the Product is made — as long as the Product was supplied in proper condition and consistent with the information provided on the Website. The customer is responsible for personally verifying the Product's fit before installation and use.

Parts of the Product appearing on the Website may be manufactured, imported, and/or supplied by third parties. The Website's customers confirm and declare that they are aware that: (1) the warranty for such parts (to the extent one exists) is provided by the manufacturer and/or importer and/or distributor and/or supplier, in accordance with the third party's policy; (2) they bear responsibility for approaching and demanding from the manufacturer and/or importer and/or distributor and/or supplier compensation for any damage, direct or indirect, caused to them that exceeds the cost of the product.

Do not rely on product specifications or descriptions appearing on the Website. The information on the product packaging should be read before use, and the product instructions should be read carefully (including minimum age for use, product assembly, product maintenance, etc.); responsibility rests with the customer.

The Website shall not be liable for any damage, direct or indirect, caused to a visitor as a result of reliance on information appearing on the Website and/or in links to other websites and/or any other internal and/or external information source and/or use of products presented by it.

Product images on the Website are for illustration purposes only. There may be differences in appearance, shade, size, and the like between the Product as presented on the Website and the Product supplied to the customer. A clerical error in a product's description and/or price shall not bind the Website.

Information and representations about products presented on the Website that originate from the Website's business partners and/or third parties whose products appear on the Website, and any content relating to such products, are the sole responsibility of those business partners and/or third parties, and accordingly the Website bears no responsibility for such information and does not vouch for its accuracy.

The Website shall not be liable for any damage (direct or indirect), loss, emotional distress, or expenses caused to visitors and/or any third parties as a result of use of, or reliance on, any content, information, data, representation, image, video, audio, advertisement, product, service, etc. appearing on the Website. Any such reliance is made at the visitor's sole discretion and responsibility.

The Website shall in no event be liable for damage caused to a Website visitor through contact with the Website's business partners or third parties.

The Website recommends that visitors act as prudent and careful consumers and read carefully the information presented on the Website, including the information regarding the Product itself, its description, and its suitability, as described on the Website.

The content on the Website is provided for use as is (AS IS). It cannot be tailored to the needs of each and every person. No claim, suit, or demand may be raised against the Website regarding the features of the content, its capabilities, its limitations, and/or its suitability to the user's needs.

Jurisdiction
